1. Application range and definitions
A wide range of information and data material is available from Bosch Thermotechnik GmbH (“BOSCH”) to the user in connection with the sale of BOSCH products and are available to download. These comprise specifically texts, excerpts from texts, images, graphics, technical and commercial data sets (data standard texts), CAD drawings, BIM models, product details, audio, video and animation files, catalogue and planning software as well as registered and non-registered word or image marks such as “Buderus”, “Bosch” and “Junkers”, hereafter referred to collectively as “advertising materials”. By downloading and/or using the advertising material made available by BOSCH, the user agrees to abide by these terms of use. In these terms, the term “user” refers to all natural and legal persons who use the advertising materials made available by BOSCH for the purpose of marketing BOSCH products.
2. Area of application of terms of use
These terms of use apply to all advertising materials BOSCH makes available to download, irrespective of where and how BOSCH makes these advertising materials available.
3. Usage and access rights:
3.1 Downloading, reproduction and/or distribution of entire web pages in which BOSCH offers advertising materials to download, and/or whole or partial sections of these web pages that are not intended for downloading by the user, is prohibited. Reproduction for technical reasons is permitted for browsing purposes in particular, provided this is not for commercial purposes, and the same applies to any reproduction for personal use.
3.2 All advertising materials made available by BOSCH to download are protected by copyright and/or trademark law. All resulting rights are reserved exclusively for BOSCH.
The sole purpose of the provision of advertising materials by BOSCH is to support the advertising presence of the user, and especially presentation of BOSCH products for customer and project acquisition purposes, to support product design and planning, and for journalistic purposes (“intended usage”). The advertising materials provided by BOSCH must only be used by users for the aforementioned purposes (Internet page, brochures, etc.). BOSCH grants the user a simple, non-exclusive, non-transferable, revocable right to use the advertising materials exclusively for these purposes, with no restriction on location and, subject to the following Clause 5, for an unlimited period.
Holding of advertising materials for transfer to third parties (in a separate download area, for example), their use in image databases, image catalogues and also the use of images in auction platforms is only permitted with the express prior written consent of BOSCH.
4. Limitation of user licence:
The interests of BOSCH must be appropriately considered at all times when using the advertising materials. The advertising materials must only be used in connection with BOSCH products and services and must in particular not be used in connection with pornographic, libellous, racist, misleading or illegal content. Furthermore, the advertising material must not be used in a manner which could be construed as offensive, obscene or illegal. Use of the advertising material in a context that endangers or is detrimental to the reputation and standing of BOSCH is expressly forbidden.
5. Term/cancellation of user license:
5.2 BOSCH reserves the right in accordance with the above provisions to cancel the user rights and, in particular, prohibit further use of all or specific advertising materials that have been made available at any time. BOSCH may in its sole discretion take the interests of the user into consideration appropriately and grant a grace use period, if applicable.
5.3 BOSCH expressly reserves the right to change, amend or delete all or some of the advertising materials provided without prior notice, and also to stop providing the advertising materials either temporarily or permanently.
6. References to the source:
When using the advertising materials provided, the user must state the source in the customary manner for the relevant application and, whenever technically feasible, on the advertising material itself or on/in the application medium, in the following form: “Bosch Thermotechnik GmbH”. Collective image credits are permitted.
7. Processing/changes:
7.2 BOSCH reserves the right to change, delete or extend the scope of the advertising materials and the individual files without prior notice. BOSCH reserves the right in particular to make changes to the version of the files loaded by the user without further notification.
7.3 Any form of processing, redesign or manipulation of the advertising materials provided, such as photographic reproduction, graphic distortion, photocomposing or modification using another electronic means, that extends beyond colour correction, excerpts and reductions, is only permitted with the prior consent of BOSCH in writing. Information must also not be rendered in a context so as to distort the meaning.
On no account whatsoever may copyright mentions, serial numbers, watermarks or other product identifications be removed or modified.
8. User fee:
The advertising materials are provided free of charge. The user is not entitled to request a fee from third parties in return for use of the advertising materials. The right of the user to request payment from third parties for services promoted in conjunction with the advertising materials remains unaffected.
9. Liability:
9.2 BOSCH shall not be liable for infringements of press law, copyright law or other laws arising from inappropriate use of the advertising materials provided, or use that distorts the meaning of the advertising materials. The user shall be solely liable for and indemnify BOSCH against all losses and claims made by third parties arising from any breach or non-observance of these terms by the user, including legal costs.
9.3 BOSCH shall only be liable for intent, gross negligence and omission of guaranteed features. This does not apply in cases of injury to life or health and in cases where the law prescribes a legally binding liability.
9.4 BOSCH shall not assume liability for the correctness and accuracy of the available data. Before using the advertising materials provided, it is the duty of the user to check their accuracy and plausibility.
9.5 BOSCH shall not assume liability for losses incurred as a result of the user using the advertising materials beyond the scope of the purposes permitted by these terms or incorrect subsequent use of the advertising materials.
10. Intellectual property
All rights to the intellectual property (including copyright, software rights, database rights, patents, know-how, underlying algorithms, trademarks, logos, brand names and other commercial identification marks and also other similar rights such as worldwide registrations, applications and renewals) subsisting in the advertising materials belong to BOSCH and/or its licensees and are protected by copyright law or other intellectual property rights. A change or misrepresentation is not permitted. Removal of notes or remarks referring to confidentiality, copyright law, trademark law, patent law and other intellectual property rights is not permitted.

12. General
12.2 In the event of invalidity of individual provisions of these terms of use, the validity of the remaining provisions shall remain unaffected.
12.3 The material laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods, shall apply. Place of jurisdiction is Stuttgart.
12.4 Any changes and or additions to these terms must be in writing.

Principles
Personal data consists of all information related to an identified or identifiable natural person, this includes, e.g. names, addresses, phone numbers, email addresses, contractual master data, contract accounting and payment data, which is an expression of a person’s identity.

Service providers (general)
We involve external service providers with tasks such as sales and marketing services, contract management, payment handling, programming, data hosting and hotline services. We have chosen those service providers carefully and monitor them on a regular basis, especially regarding their diligent handling of and protection of the data that they store. All service providers are obliged to maintain confidentiality and to comply with the statutory provisions. Service providers may also be other Bosch group companies.
Principally, we store your data for as long as it is necessary to render our Online Offers and connected services or for as long as we have a legitimate interest in storing the data (e.g. we might still have a legitimate interest in postal mail marketing after fulfillment of our contractual obligations).
